URGENT ACTION NEEDED: Erica’s Well-Being is in Danger

Erica, a young woman suffering from C-PTSD, has been unjustly incarcerated since May with an excessive bail. Her next court date is always a month away, leaving her trapped in a prison environment that is actively harming her mental and physical health.

Erica needs immediate help! She is a vulnerable, now 21-year-old with the emotional maturity of a young teen. The prison setting is exacerbating her trauma, and she is in imminent danger of further damage. 

*Erica is now at Whiting Forensic Hospital which is a state-operated inpatient facility providing services to individuals involved in the criminal justice system.  They think they can “restore her to competency” even though her traumas have left her with C-PTSD for years! The are holding her hostage!

We must act NOW to:

  • Secure Erica’s release from prison/Whiting Forensic Hospital: Her bail is excessive, and she should not be incarcerated while awaiting trial.
  • Get Erica into a caring and competent mental health facility: She volunteered for treatment and needs the support of professionals who understand her traumas.

This is a matter of saving her from further mental damage. Erica’s constitutional and human rights have been violated. The police created a false narrative to justify their actions, and Erica is paying the price. We cannot allow this injustice to continue.

Please join us in demanding Erica’s immediate release and access to the mental health care she desperately needs.  She should not have to wait in prison for a bed that could take months when her parents have arranged her on-going outpatient treatment that specializes in trauma and PTSD.

Erica is currently in the custody of Whiting Forensic Hospital in Middletown Connecticut. They are trying to “restore her to competency” so she can understand the charges against her and participate in her defense at trial.

If found competent, they will probably send her back to York correctional prison because of her excessively high Bond of $350,000, awaiting trial, which could take many more months.

Besides Erica’s basic human rights, her constitutional rights were violated as well. Specifically, her Fourth Amendment rights, which protect people from unreasonable searches and seizures by the government, and her Eighth Amendment rights, which prohibit excessive bail and cruel and unusual punishments.

When the police took her into custody, they did so without getting the medical care that she desperately needed, prioritizing their desire to arrest her. I was told by the sergeant on duty that she lost all her rights when she “attacked the cops”.

Also her HIPAA rights were violated because the police released body cam to the media which showed her mental health evaluation being conducted. You can hear the crisis worker asking Erica questions. This is highly illegal but it is what was done so that the police could try to look good in the eyes of the public.

The officer who took charge that day did so when he was only there to protect the safety of the crisis worker. He was not there to be involved directly. But yet he inserted himself aggressively. When the crisis worker gave Erica permission to sit in our car and wait for the ambulance to arrive, the officer took it upon himself to place his body upon hers on her front seat and try to fight her for the keys. In the process of this body cam shows that his arm made contact with her breasts and was rubbing on them and his hand was on her thigh and hip. That is when she whipped her vape at him and drove off. It is crucial to note that this was done without any justification of law. She was a free person. The crisis worker thanked her for agreeing to go to the hospital voluntarily because she did not meet the requirements for a hold against her will.

This specific officer was on probation in his prior town for improper pursuit violation, in which he failed to disengage despite two orders to do so, engaged in a high-speed pursuit without using his siren, and lied about that to his supervisors. So unfortunately my town later hired this tyrant and brought him into my community where he has victimized my daughter and violated her rights. She has been in jail or a mental health hospital for going on 8 months now. All because she had a PTSD attack and this officer improperly pursued her and touched her and triggered her into another PTSD attack

The best way to help is to become angry about the Injustice perpetuated against Erica and others like her. To no longer accept police abuse in mental health care calls and in constitutional rights violations.
